Ratio Decidendi

The court found that while the applicant's fear of execution was real and could render the appeal nugatory, the applicant had not sufficiently explained the inordinate delay in seeking a stay of execution. Nevertheless, the interests of justice required balancing both parties' rights. The court allowed the application for stay of execution on strict conditions: the applicant must pay the principal sum to the respondent within 30 days, deposit security for the balance of the decretal sum within 30 days, and compile, file, and serve the record of appeal within 60 days, failing which execution would issue or the appeal would stand dismissed. Costs were awarded to the respondent.
