Ratio Decidendi

The court found that the Applicant had been in open, continuous, and uninterrupted possession of the suit property for more than 12 years, as evidenced by his occupation, development of the land, and construction of a homestead. The Respondents failed to appear or contest the claim, and no evidence was presented to challenge the Applicant's assertions. The court was satisfied that the Applicant had met the legal requirements for adverse possession under Section 38(1) of the Limitation of Actions Act. Consequently, the Applicant was declared entitled to ownership and registration as proprietor of Plot No. Mugumo Pasta/Mazeras/1064 by virtue of adverse possession.
