The appellate court found that while the trial court's award of Kshs 2 million for pain and suffering was not unreasonable given the nature of the injuries and the consideration of inflation, the award of Kshs 1 million for loss of future earning capacity was excessive. The evidence showed that the respondent's disability did not affect his employment or earnings, and his apprehension of future loss was speculative. Therefore, the court reduced the award for loss of future earning capacity to Kshs 500,000 as a reasonable token, while upholding the other awards.
