Legal Issues
- 1 Whether the applicant should be allowed to serve the remainder of her sentence through a Community Service Order.
- 2 Whether the applicant's conduct warrants substitution of custodial sentence with community service.
Ratio Decidendi
The court found that the applicant was suitable for a Community Service Order and that the interests of justice would be served by allowing her to serve the remainder of her sentence under probation supervision. The court emphasized that continued compliance with the probation officer and abstention from further criminal conduct were mandatory conditions. Failure to comply would result in revocation of the Community Service Order and recommittal to prison to complete the sentence. The decision was grounded in the statutory framework permitting substitution of custodial sentences with community-based sanctions where appropriate.
Court Disposition
application for review allowed; custodial sentence substituted with Community Service Order subject to conditions.
Orders
- The applicant shall serve the remainder of her sentence through a Community Service Order under supervision of Probation Officer Mutomo.
- The applicant is cautioned to strictly cooperate with the probation officer and desist from committing any crime, failing which she will be returned to prison to complete her sentence.
