Ratio Decidendi

The Court found that the Respondent, having been duly served with the application and failing to respond or participate in the reconciliation of accounts as directed, could not contest the sums claimed by the Claimant. The Court accepted the Claimant's evidence that there were no pending loan repayments as at the date of Judgment and that the unremitted loan deductions amounted to Kshs.560,000 as pleaded in the Memorandum of Claim. The application was therefore allowed as unopposed, and the Court made a final order confirming the sums due and declined to award costs, directing each party to bear its own costs of the application.
