Ratio Decidendi

The court found that the appeal was filed out of time and without leave of court, contrary to section 79G of the Civil Procedure Act. As a result, there was no proper appeal before the court upon which to base an application for stay of execution. The court held that the application for stay of execution was therefore without basis and dismissed it with costs to the respondent. The court reaffirmed that the power to grant stay of execution is discretionary and subject to statutory requirements, which were not met in this case.
