Legal Issues
- 1 Whether the High Court has jurisdiction to review the applicant's sentence after dismissal by the Court of Appeal.
- 2 Whether the Muruatetu decision and alleged new compelling evidence warrant revision of the applicant's sentence.
Ratio Decidendi
The High Court lacks jurisdiction to review or revise the applicant's sentence after the Court of Appeal has dismissed his appeal. The Muruatetu decision does not extend to the offence of defilement, and no new compelling evidence has been presented that would confer jurisdiction or justify interference with the sentence. Accordingly, the application for revision is dismissed for want of jurisdiction.
