Additionally, the order was not endorsed with the requisite penal notice warning of the consequences of disobedience. These are mandatory procedural requirements for contempt proceedings under section 5(1) of the Judicature Act and the applicable English Civil Procedure Rules. The failure to comply with these requirements rendered the application incompetent. The court, therefore, struck out the application for contempt. No order as to costs was made due to the respondent's non-participation.
