The Respondent failed to provide the Claimant with notice or a disciplinary hearing as required by Section 41 of the Employment Act. The absence of procedural fairness rendered the termination wrongful and unfair under Section 45. The Claimant was therefore entitled to compensation for wrongful termination, notice pay, and underpayment for the relevant period. The claim for annual leave was denied as the Claimant received generous off days. Each party was ordered to bear its own costs.
