The trial magistrate's award of Kshs 700,000 for loss of dependency was set aside. The awards for pain and suffering (Kshs 10,000) and loss of expectation of life (Kshs 100,000) were upheld as they were consistent with conventional awards in similar cases and were in fact the amounts proposed by the appellant.
