The court found that the plaintiffs' cause of action is based on fraud, and under Section 26 of the Limitation of Actions Act, the limitation period begins to run from the date of discovery of the fraud. Since the plaintiffs pleaded that they only discovered the alleged fraud in 2024, the suit is not time barred. On the interlocutory injunction, the court applied the principles in Giella v Cassman Brown and Nguruman Ltd v Jan Bonde Nielsen, finding that the plaintiffs had established a prima facie case with a bona fide question as to their rights, and that they would suffer irreparable harm if the injunction was not granted.
