The Court of Appeal held that the Employment and Labour Relations Court (ELRC) correctly applied the sequential Giella v Cassman Brown test for interlocutory injunctions, finding that although the appellant established a prima facie case, she failed to demonstrate that damages would not be an adequate remedy for the alleged violations. The Court found no error or abuse of discretion in the ELRC's refusal to grant conservatory orders, as the appellant did not show irreparable harm or that the balance of convenience favoured her. The Court further held that the public interest element, as articulated in the Munya decision, need not be considered where the applicant fails the Giella test....
