Ratio Decidendi

The Tribunal found that the landlord served a valid notice to terminate tenancy under Section 4(2) of Cap 301, with an effective date of 1.08.2024. The tenant did not notify the landlord of her unwillingness to comply with the notice nor did she refer the matter to the Tribunal as required by Section 6(1) of Cap 301. Consequently, under Section 10 of Cap 301, the notice took effect on the specified date, and the Tribunal had no jurisdiction to interrogate the merits of the notice. The tenancy was therefore lawfully terminated, and the landlord was entitled to vacant possession and, if necessary, eviction of the tenant.
