Ratio Decidendi

The Judgment Debtor was only in possession of the property as a lessee, not as owner. The Plaintiff/Decree Holder failed to provide any evidence to dispute the Objector's claim. Consequently, the court held that the attachment and proclamation of the Objector's assets was improper and should be set aside, as the Objector had met the burden of proof required in objection proceedings under Order 22 Rules 51 and 52 of the Civil Procedure Rules.
