The suspension letter presented by the respondents was questionable in its authenticity and had not previously been brought to the applicant's attention. In the absence of evidence that the applicant was informed of the allegations or given a fair hearing, the Tribunal held that his exclusion from the candidature violated his constitutional rights to fair administrative action and a fair hearing. Upholding these rights, the Tribunal allowed the applicant to participate in the elections.
