The court found that the suit was filed against persons who were already deceased at the time of filing, as evidenced by the death certificates and uncontested by the plaintiffs. The law is clear that a suit cannot be maintained against a deceased person; only the legal representative of the estate may be sued. The court rejected the plaintiffs' reliance on section 54 and paragraph 14 of the 5th Schedule of the Law of Succession Act, holding that these provisions apply only to suits pending at the time of death, not to suits initiated after death.
