The court found that the Respondent failed to comply with the mandatory procedural requirements under Section 41 of the Employment Act by not giving the Claimant an opportunity to be heard before dismissal. Even if the Claimant was suspected of theft, the Respondent was obligated to explain the reasons for the contemplated termination and consider the Claimant’s representations. The summary dismissal was therefore procedurally unfair and unlawful. The court awarded the Claimant compensation for unfair termination, notice pay, salary for days worked, service pay, leave pay, and pay for holidays worked, as admitted by the Respondent.
