The counterclaim was raised as a shield to the plaintiffs' unmerited suit. Given these circumstances, the court exercised its discretion to deny the plaintiffs costs of the withdrawn counterclaim, holding that they did not deserve compensation for steps taken in defending the counterclaim, as the underlying suit itself was without merit and had already been determined in previous litigation.
