The Environment and Land Court lacks jurisdiction to stay proceedings in a succession cause pending before the High Court, as both courts are of concurrent jurisdiction. The proper procedure is for the party seeking a stay to file the application in the succession cause itself. While the ELC may determine the question of ownership of the disputed parcel of land, the High Court retains exclusive jurisdiction to determine succession matters, including the identification of beneficiaries and the distribution of the estate. The plaintiff's application for stay before the ELC was therefore misconceived and could not be granted. Each party is to bear its own costs.
