Procedural Posture

Tribunal Application / Ruling

  1. 1 Whether a landlord-tenant relationship existed at the time of filing the application.
  2. 2 Whether the tribunal had jurisdiction to hear and determine the dispute in the absence of a landlord-tenant relationship.
  3. 3 Whether the landlord was entitled to the orders sought, including eviction, rent arrears, and injunction.

Ratio Decidendi

The tribunal found that the tenant had vacated the premises prior to the filing of the application, as evidenced by unchallenged affidavit evidence. Consequently, the landlord-tenant relationship had ceased to exist, which is a condition precedent for the tribunal's jurisdiction under the Landlord and Tenant (Shops, Hotels and Catering Establishments) Act (Cap 301). Without such a relationship, the tribunal's jurisdiction was ousted, rendering it incapable of granting the orders sought. The application was therefore dismissed for want of jurisdiction, and costs awarded to the tenant.

Court Disposition

application dismissed for want of jurisdiction

Orders

  • The landlord's reference and application are dismissed for want of jurisdiction.
  • The landlord shall bear the tenant's costs assessed at Kshs. 25,000.
