The court found that although the Petitioners' counsel failed to attend the issuance of directions due to a misdiarized date, the right to a fair hearing under Article 50(1) of the Constitution required that the Petitioners not be unduly prejudiced by their counsel's mistake. The court acknowledged the existence of the e-filing system and its notification features but determined that, since the hearing of the main petition had not commenced and no prejudice would be suffered by the Respondents, it was just to set aside the directions and allow parties to take fresh directions.
