However, the court found that the plaintiff, as a registered proprietor of the suit property, retained the right to pursue the suit in his personal capacity for his own interest. Consequently, the proceedings relating to the estates of the deceased proprietors were struck out, but the suit was allowed to proceed in respect of the plaintiff's individual claim against the defendant.
