The High Court found that the process server's affidavit and cross-examination established that each appellant was properly identified and served with the relevant pleadings and hearing notices. The interlocutory and final judgments were therefore regular. The court held that, even where a regular judgment is entered, it retains discretion to set aside such judgment if the draft defence raises bona fide triable issues. Upon review, the court determined that the appellants' draft defence consisted only of bare denials and did not raise any triable issues warranting a full trial.
