Criminal Appeal / Sentence Revision Ruling
Legal Issues
- 1 Whether the sentence imposed on the appellant should be revised in light of the welfare of his dependants.
- 2 Whether probation is an appropriate alternative to imprisonment in the circumstances.
Ratio Decidendi
The court found that the continued incarceration of the appellant would cause undue hardship to his seven children and five orphaned nieces and nephews, who had become beggars and dropped out of school after being abandoned by their mother. Considering the probation officer's report and the best interests of the children, the court determined that revising the sentence to three years' probation was appropriate to alleviate their suffering. The court further held that the appellant must adhere to the terms and conditions of probation, failing which he would be returned to prison to serve the remainder of his original five-year sentence.
Court Disposition
sentence revised to probation
Orders
- The appellant's sentence is revised to three years probation.
- Failure to comply with probation terms will result in the appellant being committed back to prison to serve the remainder of the five-year sentence.
