Procedural Posture

Preliminary Objection / Ruling on Preliminary Objection to Bill of Costs

  1. 1 Whether the court has jurisdiction to entertain the Bill of Costs as filed.
  2. 2 Whether the Bill of Costs is an abuse of the court process due to the death of the 1st Petitioner.
  3. 3 Whether the firm of J.K. Mwalimu Advocates had instructions to file the Bill of Costs for the 1st Respondent and to represent the 3rd and 4th Respondents after dismissal of the Petition.

Ratio Decidendi

The court found that the issues raised by the Petitioners in their Preliminary Objection, including the alleged death of the 1st Petitioner and the authority of the firm of J.K. Mwalimu Advocates to file the Bill of Costs, are matters of fact that require evidence and cannot be determined as pure points of law through a Preliminary Objection. The court further held that the Petitioners had acquiesced to the representation of the 3rd and 4th Respondents by J.K. Mwalimu Advocates by not objecting at the appropriate time and by participating in subsequent proceedings. Accordingly, the Preliminary Objection was found to be unmeritorious and was dismissed with costs.

Court Disposition

Preliminary Objection dismissed with costs.
