Ratio Decidendi

The trial magistrate erred by imposing consecutive sentences for offences that arose from the same criminal transaction. The law requires that sentences for such offences be served concurrently. The sentences imposed were also found to be harsh given the circumstances. The appellate court therefore quashed the original sentences and substituted them with one-year jail terms on each limb of count one to run concurrently, and a one-year jail term for count two. As the appellants had already served the substituted sentences, they were ordered to be released unless otherwise lawfully held.
