Procedural Posture

Civil Appeal / Judgment

  1. 1 Whether the Land Disputes Tribunal and Appeals Committee had jurisdiction to determine disputes relating to title to registered land.
  2. 2 Whether the award of the Tribunal and Appeals Committee was ultra vires section 3(1) of the Land Disputes Tribunal Act No. 18 of 1990.
  3. 3 Whether the Tribunal's decision was inconsistent with the provisions of the Registered Land Act.

Ratio Decidendi

The court found that the Land Disputes Tribunal and the Appeals Committee acted outside their statutory jurisdiction by determining a dispute relating to title to registered land. Section 3(1) of the Land Disputes Tribunals Act expressly limits the tribunal's jurisdiction to matters of division, determination of boundaries, claims to occupation, and trespass to land, but not to questions of title. The award purporting to subdivide and transfer registered land was therefore ultra vires and inconsistent with the Registered Land Act. Consequently, the appeal was allowed, and the awards of both the Tribunal and the Appeals Committee were set aside.

Court Disposition

Orders

  • The appeal is allowed.
