Even if the land had originally been family land, the court accepted the unchallenged evidence of Kikuyu customary law that land redeemed by only one family member from a third party becomes the personal property of the redeemer and is not subject to sharing by other family members. The plaintiff was aware of the redemption process but chose not to participate. Therefore, the defendant, having redeemed the land from Kihika Muteru alone, became the sole owner of the land, and the plaintiff had no claim to it.
