The Tribunal found that the Applicants are the rightful landlords entitled to rental income from the suit premises, as previously determined in BPRT No. E599/2021. The Respondent's lease agreement with third parties was entered into after the Tribunal's judgment and in contravention of its orders, rendering it null and void. The Respondent, therefore, occupies the premises as a trespasser and is liable to pay mesne profits to the Applicants. The Tribunal has jurisdiction under Section 12(1)(e) of Cap. 301 to order recovery of possession and payment of mesne profits, even against persons not recognized as tenants. Orders

  • The Respondent shall deliver vacant possession of the suit premises on L.R NO. 209/1413/28, Accra House forthwith, failing which eviction shall be carried out by a licensed Auctioneer with police assistance.
  • The Respondent shall pay the Applicants mesne profits of Kshs.3,600,000 for the period 1st September 2021 to date at Kshs.200,000 per month, and at the same rate until vacant possession is delivered or eviction occurs.
