The appellate court found no error in the trial magistrate's conclusion that there was insufficient evidence to prove the Deceased had distributed his land during his lifetime in accordance with Kikuyu customary law, as the required formalities and credible witnesses were lacking. The court further held that no valid oral will existed because the purported oral will was made more than three months before the Deceased's death, contrary to Section 9 of the Law of Succession Act.
