Ratio Decidendi

The court found that the Respondent failed to establish a case of desertion against the Claimant, as the Claimant provided sick off sheets to justify his absence. The Respondent did not afford the Claimant procedural fairness as required by Section 41 of the Employment Act, since he was not given prior notice or an opportunity to respond to the allegations before dismissal. The dismissal was therefore both substantively and procedurally unfair. Given the Claimant’s short period of employment and the Respondent’s conduct, the court awarded three months’ salary as compensation, one month’s salary in lieu of notice, and salary for March 2017, plus interest, costs, and a certificate of service.
