The court found that the respondent, after filing a notice of appeal, failed to take any further steps to prosecute the intended appeal within the time prescribed by the Court of Appeal Rules. No memorandum or record of appeal was filed, nor was there any request for typed proceedings. More than one year and five months had lapsed since the notice of appeal was filed, with no action from the respondent. Rule 83 of the Court of Appeal Rules provides that in such circumstances, the notice of appeal is deemed withdrawn. The respondent's inaction prejudiced the applicants, who were unable to access a lawful award. The court, therefore, deemed the notice of appeal withdrawn and awarded costs...
