Ratio Decidendi

The Tribunal found that while there was no evidence of a mutually agreed 50% rent rebate, the landlord had offered a 40% rebate for May-December 2020 and did not withdraw this offer, despite the tenant paying only 50% rent. By accepting reduced payments and not objecting, the landlord is estopped from demanding full rent for the period. The only amount due is the 10% difference, totaling Kshs.128,000/-. The Tribunal cannot compel the tenant to execute a new lease, as controlled tenancies do not require written agreements. Each party is to bear its own costs, as the landlord's claim was only partially successful and the tenant opposed the application.
