The delay of six days, though not inordinate, was unexplained and the applicant did not demonstrate vigilance or good cause. The court further held that the intended appeal did not raise arguable grounds, and since the auction had already taken place and no appeal was in existence, an injunction could not be granted. Consequently, the application for leave to appeal out of time and for injunctive relief was dismissed.
