Ratio Decidendi

The court found that the application for stay of execution was filed without unreasonable delay, considering that the appeal had been filed in good time. The court accepted that the applicants might suffer substantial loss if the decretal amount is paid out and the respondent is unable to refund it should the appeal succeed. While the applicants offered a bank guarantee as security, the court found it more appropriate, given the respondent's proposal and the circumstances, to require the entire decretal sum to be deposited in a joint interest earning account in the names of the parties' advocates. The stay of execution was therefore granted on condition of such deposit within forty days.
