Ratio Decidendi

The High Court found that the trial magistrate failed to consider the issue of permanent disability when assessing general damages, despite both medical reports confirming severe injury to the appellant's left elbow and significant permanent disability (averaged at 45%). The trial court's award of Kshs.200,000 was inordinately low compared to comparable cases and did not reflect the seriousness of the injuries or the degree of permanent incapacity. The High Court therefore set aside the award and substituted it with Kshs.500,000 as general damages, less 15% contribution, plus special damages as proved, with interest from the date of the trial court's judgment.
