Procedural Posture

Environment and Land Case / Judgment

  1. 1 Whether the Environment and Land Court has jurisdiction to divide matrimonial property during the subsistence of marriage.
  2. 2 Whether the Plaintiff is entitled to half share of the suit property while still married to the 1st Defendant.
  3. 3 Whether the Plaintiff is entitled to general damages for trespass and lost income without nullification of the sale.

Ratio Decidendi

The court held that under Section 7 of the Matrimonial Property Act, matrimonial property can only be divided between spouses upon divorce or dissolution of marriage. Since the Plaintiff and the 1st Defendant are still married, the court lacks jurisdiction to divide the property as sought. The Plaintiff did not seek nullification of the sale or cancellation of title, but only division of the property, which the court cannot grant during the subsistence of marriage. The court further found that the claims for damages and lost income could only be considered if the sale was declared illegal, which was not pleaded. Accordingly, the suit was struck out for want of jurisdiction.

Court Disposition

Suit struck out for want of jurisdiction; no order as to costs.
