Procedural Posture

Criminal Appeal / Judgment

  1. 1 Whether the sentences imposed on the appellant were lawful under the Traffic Act and Criminal Procedure Code.
  2. 2 Whether the default sentences of imprisonment should run concurrently or consecutively.
  3. 3 Whether the fine imposed on count II exceeded the statutory maximum.

Ratio Decidendi

The High Court found that, except for count II, the fines imposed on the appellant were within the statutory limits prescribed by the Traffic Act. The fine for count II exceeded the statutory maximum and was therefore reduced. The court also held that since all four counts arose from a single incident, the default sentences of imprisonment should run concurrently rather than consecutively. The order for consecutive sentences was found to be vague and ambiguous. The appeal was allowed to the extent of reducing the fine for count II and ordering that all default sentences run concurrently, but the other sentences were upheld as lawful.

Orders
