Legal Issues
- 1 Whether the applicant's sentence should be revised to allow her to serve the remainder under probation order.
- 2 Whether the circumstances justify a non-custodial sentence for the applicant.
Ratio Decidendi
The court found that the applicant, having pleaded guilty to burglary, stealing, and handling stolen goods, was serving a two-year custodial sentence. The Probation Officer's Sentence Review Report confirmed the applicant's willingness to serve the remainder of her sentence under probation. In the interest of decongesting the prison and considering the applicant's readiness for rehabilitation, the court exercised its discretion to revise the sentence. The court ordered that the applicant serve the remainder of her sentence under a probation order, replacing the custodial sentence with a non-custodial one.
Court Disposition
Application for sentence revision allowed. Applicant to serve remainder of sentence under probation order.
Orders
- The applicant shall serve the remainder of her sentence under a probation order.
- The custodial sentence is substituted with a non-custodial probation order.
