Procedural Posture

Employment Cause / Judgment

  1. 1 Whether the termination of the Claimant’s employment was lawful and fair.
  2. 2 Whether the Claimant is entitled to the remedies sought.

Ratio Decidendi

The court found that while the Respondent had a valid substantive reason for terminating the Claimant’s employment due to repeated administrative lapses, the disciplinary process was procedurally unfair. The Claimant was given insufficient time to respond to show cause letters and was not formally invited to the disciplinary hearing with adequate notice or details of the charges. This compromised the procedural fairness requirements under Section 41 of the Employment Act. Consequently, the termination was held to be procedurally unfair, entitling the Claimant to compensation and notice pay, but not to the annual bonus, which was not proved.

Court Disposition

Judgment for the Claimant in part; termination held procedurally unfair; compensation and notice pay awarded.
