The court found that several respondents were already deceased at the time the petition was filed, and that the petitioners were aware or ought to have been aware of this fact. Under Order 24 of the Civil Procedure Rules, a suit against a deceased person is a nullity, and where no substitution is made within the prescribed period, the suit abates by operation of law. The court further held that it has no jurisdiction to revive or substitute parties in a suit that has already abated.
