Ratio Decidendi

The court found that although the delay in filing the appeal was only two days and not inordinate, the appellant failed to seek leave of the court to file the appeal out of time as required by law. Furthermore, the appellant did not oppose the application or provide any explanation for the delay. In the absence of any response or justification from the appellant, and in line with Section 79G of the Civil Procedure Act and relevant case law, the court held that the appeal must be struck out for being filed out of time without leave of the court.
