The respondent failed to establish valid reasons for termination or demonstrate that due process was followed as required by Sections 41 and 45 of the Employment Act 2007. The dismissal was therefore unlawful and unjustified. The claimant was entitled to compensation for unfair termination, including salary in lieu of notice, damages equivalent to 12 months' salary, and other terminal dues.
