The court held that the application for dismissal was brought under the wrong provision of law, as Order 17 Rule 2(3) applies to suits and not appeals. The proper procedure for dismissal of an appeal for want of prosecution is under Order 42 Rule 35 of the Civil Procedure Rules, which requires that the appeal be admitted and directions given before such an application can be entertained. In this case, the appeal had not been admitted nor had directions been issued. Furthermore, the appellant had demonstrated efforts to obtain the necessary proceedings to prepare the record of appeal. Therefore, the application lacked merit and was dismissed.
