The appellant's defense that he believed the complainant was an adult did not meet the requirements of Section 8(5) of the Sexual Offences Act, as there was insufficient evidence of deception or reasonable belief. However, in light of the Supreme Court's decision in Muruatetu, the court held that the mandatory minimum sentence of 20 years was harsh and excessive, and exercised discretion to reduce the sentence to 10 years'...
