The court found that the Appellant/Respondent executed the decree by selling the Respondent/Applicant's land at a price below the reserve price set by the court, thereby failing to maximize recovery as ordered. The land, measuring 0.135 hectares (equivalent to three 50x100 ft plots), should have been sold for Kshs. 2,100,000/- (Kshs. 700,000/- per plot), but was sold for only Kshs. 1,200,000/-. The court held that the Appellant/Respondent could not claim the full outstanding balance of the decretal sum as if the reserve price had been met. Instead, the only recoverable balance was the difference between the decretal sum and the amount that should have been realized at the reserve price...
