Procedural Posture

Civil Appeal / Ruling on Post Judgment Motion for Amendment and Release of Funds

  1. 1 Whether the court order dated 9/2/2023 should be amended to correctly identify the relevant Land Registrar for LR No. Laikipia/Mutitu Ngoru Block 4/273 (Manguo).
  2. 2 Whether the applicant is entitled to the release of Kshs. 643,000 from the Kshs. 1,200,000 deposited in court by the respondent.
  3. 3 Whether the application should be granted in the absence of opposition from the respondent.

Ratio Decidendi

The court found that there was a clear error in the previous order, which incorrectly referred to the Land Registrar for Nyandarua instead of Laikipia West, where the records for the subject land are actually held. The applicant's entitlement to Kshs. 643,000 from the Kshs. 1,200,000 deposited in court by the respondent had already been determined in an earlier ruling. The court held that the orders sought were necessary to give effect to its previous decisions and facilitate execution. As the application was unopposed and the facts were supported by the record, the court allowed the application in terms of the prayers for amendment and release of funds, but made no order as to costs.

Court Disposition

Application allowed in terms of prayers 1 and 2; no order as to costs.
