Although there are pending appeals challenging this jurisdiction, the Court of Appeal has granted temporary stay orders, effectively restoring the magistrate's courts' jurisdiction until the appeals are determined. Therefore, the application for transfer of the suit from the magistrate's court to the Environment and Land Court was found to lack merit and was dismissed.
