Ratio Decidendi

The High Court lacks jurisdiction to review and set aside the taxing master's order as such applications for review must be made to the trial court under Order 45 Rule 1 of the Civil Procedure Rules. The only proper avenue for challenging a taxation ruling is by reference to a judge in accordance with paragraph 11 of the Advocates Remuneration Order. There was no error apparent on the face of the record, no new evidence, and no sufficient reason to warrant review. The application was therefore incompetent and without merit, and the applicant is liable for the respondent's costs.

Court Disposition

Application dismissed with costs to the respondent.

Orders

  • The notice of motion application dated February 15, 2023 is dismissed for lack of merit.
  • Costs are awarded to the respondent and assessed at Ksh 30,000 all inclusive.
