Civil Appeal / Ruling on Notice of Motion for Stay of Execution Pending Appeal

  1. 1 Whether the Applicants met the conditions for stay of execution pending appeal under Order 42 Rule 6 of the Civil Procedure Rules.
  2. 2 Whether the Applicants demonstrated substantial loss.
  3. 3 Whether the application was brought without unreasonable delay.

Ratio Decidendi

The Applicants satisfied the threshold for stay of execution because the application was timely, substantial loss was shown by the risk of execution and the Respondent’s alleged inability to refund, and the Applicants offered acceptable security through a bank guarantee. The court therefore granted stay on condition that a bank guarantee for the decretal sum, costs, and interest be furnished within thirty days, failing which the stay would lapse.
